During the week of January 22, 2024, to January 28, 2024, the Service Juridique received and managed a total of 16 consultations related to various consumer protection issues. These consultations were conducted through different communication channels, including e-mail, video calls, telegram, and social media platforms such as reddit, messanger, and mastodon.
In six instances, consumers sought advice regarding unfair business practices that were not further specified. Our team provided guidance on how to document these practices thoroughly and advised consumers to formally notify businesses about their grievances, outlining the steps they can take to seek redress under EU consumer protection laws.
The topic of GDPR was addressed in four consultations. Consumers primarily expressed concerns about potential violations of their data privacy rights. They were advised on how to request their personal data records and the procedures for submitting a complaint if their requests were not handled to satisfaction.
Two cases involved issues with pseudo medicine and health products that were not associated with food. These consumers were advised on identifying legitimate health claims and practicing caution with treatments that lack scientific backing. We recommended reporting any suspicious advertising claims to relevant authorities.
Pricing transparency was a concern in three consultations. Consumers reported discrepancies in advertised prices versus the final checkout amounts. We provided these consumers with advice on their right to clear pricing information, and suggested documenting all communications with vendors for potential dispute resolution.
Lastly, travelers’ rights, specifically related to train travel, were discussed in one case. The consumer was informed of their rights regarding delays and cancellations and was guided on submitting a claim for compensation as per EU travel regulations.
In one instance, a consultation could not be completed successfully as the issue presented fell outside the geographical scope of the EU consumer watchdog’s mandate. In such rare circumstances, we clarify the limits of our jurisdiction to the consumer.
The diversity of topics handled this week reflects ongoing and multifaceted challenges faced by consumers. We continue to focus on providing relevant and accurate guidance within our jurisdiction, reinforcing consumer rights and protection.
This week counseling was provided by WhizzBang Viadrina.
