Weekly Report, 2024-06-10 to 2024-06-16

The week from June 10 to June 16, 2024, at the Service Juridique was marked by a steady stream of consumer inquiries and consultations. Over the course of the week, we handled a total of sixteen consultations through a variety of communication channels, including phone, Mastodon, Reddit, Messenger, video call, and e-mail.

The predominant topic of concern was related to (unfair) general terms and conditions, which arose in nine cases. Consumers frequently reported issues with unclear and potentially exploitative contract clauses from service providers. In such cases, our advice typically consisted of scrutinizing the terms, emphasizing the importance of transparency, and guiding consumers on how to formally contest unfair terms through the relevant legal remedies available within the EU framework.

Another significant topic of attention was the right to repair, which featured in seven consultations. Consumers expressed difficulties in accessing repair services or faced obstacles from manufacturers refusing to provide necessary parts or documentation. In these situations, consumers were advised to assert their rights under the EU legislation that supports the right to repair, encouraging them to insist on the provision of repair services or parts, and how to proceed if resistance is met from businesses.

Across these interactions, there was a rare instance where our consultation did not extend to a resolution due to the issue being beyond the purview of a consumer protection agency, as it involved taxation matters occurring outside the EU. However, all other cases were thoroughly articulated, ensuring that consumers were equipped with the knowledge and steps necessary to address their concerns effectively.

The variety of communication means utilized indicated that while traditional methods like phone consultations remain popular, there is a growing propensity for using digital platforms such as Mastodon and Reddit, reflecting a shift in consumer preferences for more modern and accessible forms of communication.
