When was WhizzBang aisbl founded?
WhizzBang aisbl was founded in Dezember 2023 as an informal cooperation of our consumer protection entities; legal personhood was granted on 2024-06-17.
What are your sources of its funding in general?
How to read this
This disclosure provides a transparent overview of the entity’s funding structure, combining general funding categorieswith their actual financial composition in specific reporting periods. The purpose is to allow readers to assess not only which types of funding are permissible, but also which types were effectively relied upon in practice.
The upper section lists all funding categories that may, in principle, exist under the entity’s statutes and legal framework. The year-specific sections below show the real distribution of funds received in the respective periods.

- donations by individuals (individuals will be named here if the payment is ten thousand Euros or more in a year, unless the donation originates from inheritance or estate).

All percentages refer to the share of total funding in the relevant reporting period. A value of 0% indicates that no funds were received from that category during the period in question.
Membership fees and donations are reported separately to distinguish obligatory payments linked to membership rights from voluntary contributions without consideration. Penalties and other funding are listed for completeness, even if no such funds were received, in order to provide a full and comparable picture of potential funding sources.
Where required by transparency rules, individual donors are named once a defined annual threshold is exceeded, unless the donation originates from inheritance or estate-related transfers.
This disclosure is intended to enable a clear, factual assessment of financial independence, funding origin, and potential influence, without requiring prior accounting or legal expertise.
Definition
Membership fees
Mandatory financial contributions paid by members in exchange for defined membership rights, such as participation in the organization, voting rights, access to member services, or other benefits explicitly linked to membership status. Membership fees do not constitute donations and do not entail individualized services beyond those generally associated with membership.
Donations made by non-profit organizations
Voluntary financial contributions made by legally recognized non-profit, charitable, or civil-society organizations, without contractual obligations, service delivery requirements, or influence over governance, strategy, or operational decisions of the recipient entity.
Donations made by business
Voluntary financial contributions made by for-profit entities or commercial enterprises, provided without any contractual exchange of services, advertising, preferential treatment, or influence over the recipient’s activities. Such donations do not constitute sponsorship, procurement, or commercial cooperation.
Donations made by individuals
Voluntary financial contributions made by natural persons acting in a private capacity, without expectation of material benefit, preferential access, or influence over decision-making processes of the recipient entity.
Compensations (paid by business)
Payments made by business entities as a result of legal, regulatory, or contractual penalties, including court-ordered payments, settlement-based penalties, compensations or statutory sanctions. These payments are not voluntary donations and do not confer any rights, services, or influence upon the paying entity.
Public funding
Financial contributions provided by public authorities, including governments, ministries, agencies, municipalities, or other state-affiliated bodies, whether at local, national, or supranational level. Public funding may take the form of grants, subsidies, project-based funding, or statutory allocations and may be subject to specific legal, reporting, or use-of-funds requirements. Public funding does not include penalties or court-ordered payments made by public bodies unless explicitly designated as such under applicable law.
Other funding
Funds received under a formal contractual arrangement involving a defined exchange of services or deliverables, including but not limited to research assignments, expert reports, technical assistance, or operational services or the sale (or transfer) of goods. Such funding constitutes earned revenue and is not classified as a donation.

Do you received donations from traders or enterprises?
No.
How is it that you have a legitimate interest in protecting consumer interests?
Not only does our work suggest, that we intensify our protection for expat consumers, but our statute demands for it, too.
Are you a non-profit-making organization?
Yes we are. Please see our statute for details.
Are you subject of insolvency proceedings or have you been declared insolvent?
Neither. Insolvency proceedings would usually be published via the RegSol.
How are you independent and not influenced by persons (other than consumers), in particular by traders, who have an economic interest in the bringing of any representative action, including in the event of funding by third parties?
We are independent of these groups. You can learn more about how this is from our common code-of-conduct.
To that end of independence and non-influence, have you established procedures to prevent such influence and how do you prevent conflicts of interest between yourself, your funding providers and the interests of consumers?
Yes, we have established (and routinely revise) such procedures. For details please see our code-of-conduct.
What’s your organisational structure?
As laid out in our statute we have a board and a general assembly.
In the WhizzBang network, we also have a common legal service (Service Juridique) for which all members share the costs.

TITRE II – DE L’OBJET ET DU BUT DE L’ASSOCIATION
Article 2
2.1. L’objet non lucratif de l’Association est le suivant : la protection des consommateurs, en tenant compte en particulier des réalités de l’unification européenne, de ses effets réels sur les consommateurs et des enjeux de la poursuite de l’intégration européenne. Ce but comprend notamment la protection des intérêts des consommateurs en ce qui concerne leur santé, la protection contre l’exploitation, tant économique que de leur attention (“économie de l’attention”), contre la discrimination et la protection de leurs données à caractère personnel, de leur liberté de choix (y compris le droit à un choix éclairé).
Les préoccupations et les intérêts des personnes qui résident, vivent, travaillent ou suivent une formation dans un pays autre que leur pays de naissance ou de nationalité (“expatriés”) en font tout particulièrement partie.
L’objectif est notamment de garantir, d’étendre et d’intensifier la participation de tous aux avantages de l’unification européenne et d’atténuer les inconvénients des processus de transformation, afin de parachever l’espace commun de liberté, de sécurité et de justice, car nous sommes convaincus que le destin de notre Union se décidera en fonction du destin que supporteront les personnes les plus marginalisées.
L’un des objectifs est également d’améliorer l’accès au droit harmonisé dans les États membres (y compris les futurs pays candidats).
2.2. Pour atteindre ces objectifs, les activités de l’Association comprennent de manière non exhaustive les éléments suivants :
- l’information,
- la sensibilisation,
- le conseil
- la défense juridique des droits des consommateurs (avec ou sans mandat).
Pour atteindre ces objectifs et buts, l’association utilise les possibilités offertes par la communication digitale et l’espace virtuel et coopère avec les institutions de l’UE et d’autres institutions qualifiées ayant un objectif ou un but similaire.
Le travail est effectué en tenant compte de la diversité linguistique et culturelle de l’Union européenne et de ses habitants.
2.3. Elle peut accomplir tous les actes se rapportant directement ou indirectement à son but ou qui peuvent développer ou faciliter l’accomplissement de son objectif. À cette fin, elle peut accomplir tous les actes juridiques utiles, y compris la conclusion de contrats, l’engagement de personnel, la signature de contrats et la souscription d’assurances, tant sur le territoire national qu’à l’étranger. Elle peut notamment prêter son concours et s’intéresser à toute activité similaire à son but.
2.4. Elle peut obtenir des subventions d’institutions publiques et privées, mener des activités de sponsoring et envoyer des représentants au niveau national et à l’étranger, ainsi qu’agir comme sa propre représentation.
2.5. L’Association exerce une activité à but non lucratif conformément aux dispositions du Code des sociétés et des associations.
Elle est autorisée à exercer une activité commerciale dans la mesure où elle correspond à son but décrit au point 2.1 et dans la mesure où les bénéfices sont utilisés pour atteindre ce but. Elle peut posséder ou acquérir tous les biens mobiliers et immobiliers nécessaires à la réalisation de son but et exercer tous les droits de propriété et autres droits réels sur ces biens.
2.6. Au regard de l’exercice des activités de l’Association, les Membres ne visent pas à acquérir des gains directs et ne solliciterons pas de la part de l’Association que celle-ci procure aux Membres de tels gains directs.
2.7. L’Association est ouverte à toute coopération avec d’autres associations quand cela est jugé approprié par ses Membres.
