WhizzBang Urges EU to Strengthen Enforcement Against Cross-Border Trade Barriers

Brussels, February 22, 2024 – WhizzBang, the European network dedicated to consumer and data protection for expatriates, expresses concern over recent reports highlighting the European Commission’s insufficient action against member states that implement measures hindering the EU single market. Such national barriers not only disrupt cross-border commerce but also adversely affect expatriates who rely on seamless access to goods and services across the European Union.

Industry bodies, including Europen and EuroCommerce, have criticized the Commission for its inaction, particularly regarding Spain, Italy, and France, which have enacted laws disrupting EU supply chains. Despite the Commission’s efforts, enforcement actions have declined significantly since 2020, with fewer infringement cases and a decreased number of new cases opened against member states. Former Italian premiers have warned that the EU risks falling behind globally without stronger enforcement of single market rules. Commission President Ursula von der Leyen aims to improve these rules to boost the EU economy. Although the Commission claims better transposition of EU rules into national laws reduces infringements, industry groups argue that inconsistent national laws create barriers and complicate business operations. The UK has delayed its packaging labeling updates to avoid conflicts with EU laws, exemplifying the complexities of regulatory alignment in the single market. 

Expatriates, who often reside in one member state while maintaining economic and social ties with others, are particularly disadvantaged by these barriers. Obstacles such as inconsistent regulations and protectionist policies impede their ability to access diverse markets, secure employment opportunities, and fully exercise their rights within the EU.

“The integrity of the EU single market is paramount for ensuring that all citizens, including expatriates, can benefit from the freedoms it promises,” stated Iwona Szczeblewski, board member of WhizzBang Viadrina. “We call upon the European Commission to intensify its enforcement actions against member states that erect unjustified barriers, thereby safeguarding the principles of free movement and fair competition.”

WhizzBang advocates for the following measures:

  • Enhanced Monitoring: Implement robust mechanisms to detect and assess national measures that may contravene single market principles.
  • Timely Enforcement: Accelerate infringement procedures against member states that introduce unjustified barriers to cross-border trade and mobility.
  • Stakeholder Engagement: Foster collaboration with industry bodies, consumer organizations, and expatriate communities to identify and address emerging challenges within the single market.

By reinforcing its commitment to the single market, the European Commission can ensure that all EU residents, regardless of their country of origin or residence, enjoy equal access to opportunities and resources across the Union.
